FINNEGAN, Circuit Judge.
We considered and disposed of a prior appeal in this case on May 6, 1947, 161 F.2d 811.
It then appeared that the original complaint of Fargo Glass & Paint Company, which sought to recover damages for cancellation by the defendant Globe American Corporation of a written contract with plaintiff, was dismissed by order of the District Court on defendant’s motion.
