J. K. Shippey & Brother, a partnership composed of J. K. Shippey and T. J. Lokey, brought an action against the Central of Georgia Railway Company for damage to certain hogs in course of shipment. After evidence had been introduced, the court directed a verdict for the railway company. A motion for a new trial was sustained, and the defendant excepted.
The petition contained two counts, the first based on the Civil Code (1910), § 2777, and the second on the common law. If a verdict was not demanded for the carrier on both of the two counts, the court erred in directing a verdict for it, and…
