OPINION

KRAFT, District Judge.

On December 12, 1966, the Court sua sponte, directed the parties to submit briefs on the question whether this action for treble damages, brought under the antitrust laws, (15 U.S.C.A. §§ 1, 15) should be maintained as a class action under the recently amended provisions of Rule 23(a), (b) and (c). 1 Timely hear ing was held thereafter. Upon careful consideration of the respective contentions of the parties, we have concluded’ that this suit is not to be maintained as a class action.
