This ease arises out of the failure of the defendant Greenridge, Inc., to complete certain road and drainage improvements on approved subdivision plats in accordance with town specifications. The plaintiff town of Brookfield sought damages against Greenridge, in the first count of a two-count complaint, for its failure to complete the improvements. The second count was against Green-ridge as principal and Travelers Insurance Company as surety on a performance bond posted by both defendants in connection with the subdivision approval.
