Now pending before the court is Defendants’ motion to dismiss or, in the alternative, for summary judgment. This case centers on Plaintiffs contention that, in denying Plaintiff a zoning permit for its proposed methadone treatment program, Defendants violated Plaintiffs rights under the Americans With Disabilities Act (“ADA”) and the Due Process Clause of the Fourteenth Amendment. 1 In their motion, Defendants respond by asserting a variety of immunity and substantive defenses that they contend require the court to enter judgment in their favor.
