This products liability action is before the Court on several pending motions. Previously, defendant C.R. Bard, Inc. (hereinafter “Bard”) filed a motion to dismiss [Doc. 13] and defendants Johnson & Johnson and Ethicon, Inc. (collectively hereinafter “Ethicon”) filed a motion for judgment on the pleadings [Doc. 17].
