The plaintiff in error, Higgins, who was an experienced carpenter, employed the defendant in error, Whit-*420more, along "with, other carpenters and laborers, to assist him in the construction of a dwelling-house for himself in the section of Norfolk county known as Glenwood Park. Higgins, with the assistance of two laborers, personally erected a scaffold for the use of his employees in weatherboarding and other work on the building.
