ORDER
WOODCOCK, District Judge.
There are three motions currently pending before the court: a Motion for Summary Judgment filed by Defendant Apple- bee’s Northeast, Inc. and two Motions to Strike, each filed by Plaintiff Ricci against Applebee’s statements of material fact. Ms. Ricci initiated the pending action in state court, alleging age related discrimination in violation of the Maine Human Rights Act. 5 M.R.S.A. §§ 4551-4555 (West 2003). Applebee’s removed the case to this court on the basis of its diversity jurisdiction. 28 U.S.C. §§ 1441, 1446 (West 2003).
