SINGAL, Chief Judge.
Plaintiff Walter Toomey alleges that Unum Life Insurance Company of America and UnumProvident Corporation (together “Defendants” or “Unum”) unlawfully denied him long term disability benefits. Through this action, he seeks relief pursuant to the Employee Retirement Income Security Act (“ERISA”), 29 U.S.C. § 1132.
