This appeal represents the latest round in litigation involving Carpenters District Council of New Orleans and Vicinity Local Union No. 1846 (the “Union”) and various employers of union and nonunion construction workers in the New Orleans area. On March 14, 1980, the Union filed formal charges with the National Labor Relations Board (“NLRB” or the “Board”) against ten employers (the “employers” or “companies”) alleging that the employers had engaged in unfair labor practices within the meaning of §§ 8(a)(1) and (5) of the National Labor Relations Act, 29 U.S.C. §§…
