Appeal by the People, as limited by their brief, from so much of an order of the Supreme Court, Kings County (Gorges, J.), dated June 5, 1991, as granted that branch of the defendant’s omnibus motion which was to dismiss Kings County Indictment Number 157/91, charging him with robbery in the first degree and grand larceny in the fourth degree, to the extent of reducing the count of robbery in the first degree to robbery in the third degree.

Ordered that the order is reversed insofar as appealed from, on the law, that branch of the defendant’s omnibus motion which was to dismiss the indictment…
