Barone, J., at jury trial and sentence), rendered July 13, 2004, convicting defendant of assault in the first degree and criminal possession of a weapon in the second degree, and sentencing him to concurrent terms of eight years and SVa years, unanimously modified, on the law, to the extent of vacating the DNA databank fee, and otherwise affirmed.
