Appeal from an order of the County Court of Tompkins County (Barrett, J.), entered November 21, 1993, which partially granted defendant’s motion to dismiss the indictment.
The issue before us is whether County Court properly dismissed counts of the indictment charging defendant with *765resisting arrest and criminal mischief based on inadequate proof before the Grand Jury and insufficient instructions.
