This action was brought by the plaintiff pension plans against the defendant insurance company alleging breach of fiduciary duty under the Employee Retirement Income Security Act of 1974 (“ERISA”), 29 U.S.C. § 1001, et. seq. and for breach of contract. Before .the Court is the defendant’s motion for summary judgment, filed May 22, 1997 (document #8), and the plaintiffs’ motion for summary judgment, filed May 23, 1997 (document # 12).
