Plaintiff Jo Davis Hallingby (“Halling-by”), as Executrix of the Estate of Paul Hallingby, Jr., brought this action in New York State Supreme Court against defendant Mai V. Hallingby, now known as Mai V. Harrison (“Harrison”) and the Metropolitan Life Insurance Company (“Met-Life”) to enforce the marital property settlement between decedent Paul Hallingby, Jr. (“Paul Hallingby”) and Harrison, his former wife, and recover certain annuity benefits.
