The respondent was convicted of a violation of section 11547, 3 Comp. Laws (5 How. Stat. [2d Ed.] §14593), by feloniously and burglariously breaking and entering the store building known as the Bank of Mt. Morris, not adjoining to or occupied with a dwelling house, being then and there the property of Charles D. Stanley, with intent the goods and chattels of Charles D. Stanley in the said bank *139then and there being found, feloniously and burglariously to steal, take, and carry away, at the village of Mt. Morris, in the county of Genesee, on the night of November 24, 1908.
