Appeal from a judgment of the Supreme Court, rendered at a Trial Term for the county of Monroe, November 10, 1898, upon a verdict convicting the defendant of the crime of murder in the first degree. The facts, so far as material, are stated in the opinion.

Martin, J.:

On the morning of September 9, 1897, at Churchville, in the county of Monroe, a most horrible tragedy occurred. The victim was the defendant’s wife. On the following morning the defendant was arrested and charged with having caused her death. In November, 1897, he was indicted for the crime of murder in the first degree, was subsequently tried, and on November 4, 1898, was convicted of the crime charged. On November tenth he was sentenced to be executed in the manner provided by law. At the time of the homicide the defendant was sixty-three years of age and his wife sixty-one. They…
