MEMORANDUM OPINION

MANUEL BARBOSA, Bankruptcy Judge.

This matter comes before the Court on a motion to dismiss filed by defendant-debt- or Charles W. Fairgrieves, IV (the “Debt- or”) on October 7, 2009, pursuant to Fed. R.Civ.P. 12(b)(6), made applicable by Fed. R. Bankr.P. 7012. 1 For the reasons set forth herein, the Court grants the Debtor’s motion to dismiss.
