This action ivas commenced by the state of Oklahoma, on the relation of J. D. Lankford, state bank commissioner, against A. AV. and S. E. Marshall, to recover judgment upon a promissory note and to foreclose a real estate mortgage securing the same, said note and mortgage bearing date, June 10, 1913, signed by the said A. AV. and S. E. Marshall, and payable to J. D. Lankford, bank commissioner. The parties will be referred to as plaintiff and defendants, according to their position in the lower court. The defendants, A. AV. and S.
