BLOODWORTH, Justice.

This is an appeal by defendants Fleming from a summary judgment granted plaintiff, Alabama Farm Bureau Mutual Casualty Insurance Company, in a declaratory judgment proceeding filed by the insurer.

Appellant Jeffrey Fleming, a minor who sues by his father and next friend, George Fleming, brought an action in the Circuit Court of Houston County against Mrs. Alberta Fleming (grandmother of Jeffrey and mother of George) alleging that Jeffrey received injuries while riding as a passenger in an automobile driven by Mrs. Fleming as a proximate result of Mrs. Fleming’s negligence…
