Plaintiff petitions for Supreme Court review of our opinion. 105 Or App 213, 804 P2d 1187 (1991). We treat the petition as one for reconsideration, ORAP 9.15(1), allow it and modify our opinion.
Plaintiff first argues that we erred when we held that his statements to a county commissioner regarding a policy implemented by defendant Baggett to ascertain whether restaurants were complying with the Klamath County Health Department’s catering licensing procedure were not about a “public concern” and therefore were not protected speech under the First Amendment.
