Appeal from a judgment entered in favor of the plaintiff upon an alleged cause of action for 'damages arising because of defendant’s failure to perform the obligations imposed by written contract.

The ease went to judgment after answer and trial. The only contention made by appellant, however, is that the court erred in overruling his demurrer, which was interposed to the complaint of plaintiff. It is insisted that the complaint failed to state facts sufficient to constitute a cause of action.
