This is an action of tort by the corporate plaintiff to recover compensation for damage to its automobile and by the other plaintiff, Margaret Clancy, a passenger in that automobile, to recover damages for personal injuries and consequential damages arising out of a collision with a truck owned by the defendants and operated by their employee or agent.

The collision occurred at the intersection of Beacon and Washington Streets in the Town of Brookline at about ten o’clock in the morning on March 14, 1951. There was a finding for the defendants. The case was reported for our determination…
