OPINION

BRUGGINK, Judge.

Plaintiff Stephen Moyer challenges a denial by the Army Board for Correction of Military Records (ABCMR) of his application to correct his military records to show that he was discharged due to physical disability, rather than as a result of his resignation for the good of the service. Pending are the government’s motion to dismiss or, in the alternative, for summary judgment based on the administrative record, and plaintiffs cross-motion for summary judgment.
