Appellant Kevin Newsom appeals the district court’s summary judgment in favor of appellee Ballinger Independent School District (“Ballinger”). The district court rendered two identical summary judgments in 2005 — one in April and one in August — disposing of all claims and parties. The Texas Department of Insurance, Division of Workers’ Compensation 1 (the “Division”) contends that the second summary judgment is void because it was signed after the district court’s plenary power had expired.
