This action was commenced December 12, 1924, to foreclose a mortgage on real estate. Service was had on the defendants, other than James Bland Cattlett, by publication. The latter was served and appeared by answer, and the other defendants defaulted. The cause was tried before the court on February 23, 1927, without a jury, after the conclusion of which, on May 1, 1928, a decree of foreclosure and sale was regularly entered expressly absolving the defendant James Bland Cattlett from liability to pay any deficiency in the event that upon sale of the property sufficient money was not realized…
