This appeal and cross appeal have been taken from a judgment rendered by a state referee exercising the powers of the Superior Court. The judgment awarded the plaintiff, Stephen Kunian, trustee in bankruptcy for A. Merowitz and Company, Inc., $32,164.94 plus interest as damages for breach of contract against the defendants Development Corporation of America and DCA Builders, Inc. The defendant DCA Builders, Inc., is a wholly-owned subsidiary of Development Corporation of America and Development Corporation of America acted as the agent of DCA Builders, Inc., in the construction of the Church…
