This action was brought to recover for the death of Ziba B. Hoyt and for personal injuries to Mary E. Hoyt. The cause was tried to the court and a jury, and the defendant, before it was submitted to the jury, challenged the sufficiency of the evidence and moved for a judgment in its favor, which motion was denied. The jury returned a verdict for the defendant, and the plaintiffs moved for a new trial. This motion was also denied. Judgment was entered dismissing the action, from which judgment the plaintiffs appeal.
