Helen M. Ryan (plaintiff) brought suit against City of Chicago for personal injuries suffered as a result of a fall on a sidewalk. The City filed a third-party complaint (later amended) against Marshall Field & Company, Pepper Construction Company and Anthony J. Bongiomo, doing business as N. J. Bique. The case was tried before a jury. The trial court sustained the motions of Field and Pepper and directed verdicts in their favor on the third-party complaint.
