MEMORANDUM OPINION AND ORDER
NORDBERG, District Judge.
I. INTRODUCTION
The plaintiffs in this case—Jody, Lisa, and Linda Parsons—have sued the defendant members of the Federal Protection Service—David Aguirre, Joe Paul, and Edward Nance—in their official and individual capacities pursuant to Bivens v. Six Unknown Named Agents of Fed. Bureau of Narcotics, 403 U.S. 388, 91 S.Ct. 1999, 29 L.Ed.2d 619 (1971).
