Richard Lewellen once more comes before us in his pursuit of a Bivens action against eight federal officers arising out of his arrest and detention in January 1983. This appeal' is from a lawsuit filed on February 27, 1987, against state and federal officers, styled Lewellen v. Dwyer. On January 29, 1988, the district court dismissed the federal defendants because Lewellen failed to serve them with process within 120 days after filing the complaint as required by Fed.R.Civ.P. 4(j).
