[¶ 1] Timber Gorman appeals from a judgment of the Superior Court (Kennebec County, Studstrup, J.), entered following a jury-waived trial, in favor of Maine Eye Care Associates P.A. on its claims against Gorman alleging unjust enrichment and fraudulent misrepresentation. Gorman argues that the findings of unjust enrichment and fraudulent misrepresentation lack adequate support in the record; that the court applied the wrong standard of proof for fraudulent misrepresentation; and that the court employed an arbitrary, unsupported, and improper measure of damages.
