Plaintiffs (“Ross-Simons”) seek damages for alleged breach of contract and related claims arising out of a 1992 agreement. Two motions by defendant (“Baccarat”) are now before the Court: a motion for summary judgment as to all counts of plaintiffs’ Amended Complaint and a motion to dismiss, or in the alternative, to strike plaintiffs’ claims for punitive damages and Count VI of the Amended Complaint.
