MEMORANDUM
YOHN, District Judge.
This is an action under the Comprehensive Environmental Response, Compensation, and Liability Act (“CERCLA”), 42 U.S.C. §§ 9601 et seq. Plaintiff, SmithKline Beec-ham (“SKB”) and defendant, Rohm and Haas Company (“R & H”), entered into a consent decree with the United States in which both parties agreed to jointly undertake at their own expense to clean up an environmentally contaminated site. Both companies owned and operated, at different times, Whitmoyer Laboratories — the business that caused the site to become contaminated.
