It is first contended that the court considered improper evidence in fixing the amount of the solicitor’s fee. The complainant called six attorneys, who testified they were engaged in the active practice of law in the county of Cook, that they were acquainted with the usual and customary fees of solicitors in partition suits in said county, and that $5000 was a reasonable solicitor’s fee in said case.
