London, plaintiff in error and plaintiff below, seeks to review a judgment of dismissal based upon a plea of res judicata.

The complaint is in three counts and charges that plaintiff was employed by defendant, and in January, 1920, a partnership was formed between them whereby plaintiff was to receive each year, in addition to his salary, one-fifth of the yearly net profits of the business; that he worked under such an arrangement from January, 1920, until April 28, 1924; that the net profits of said business during this time were $85,000, of which plaintiff claims one-fifth.
