RIPPLE, Circuit Judge.

In November 2001, a grand jury returned a two-count indictment against Joel Villegas; the indictment charged Mr. Ville-gas with one count of possessing with intent to distribute cocaine in violation of 21 U.S.C. § 841(a) and with one count of carrying a firearm in relation to a drug trafficking offense in violation of 18 U.S.C. § 924(c). Mr. Villegas moved to suppress the evidence on which the indictment was based.
