This is an appeal by defendant Los Angeles Gas and Electric Corporation from a judgment after verdict in an action for personal injuries. Plaintiff, a youth of nineteen, recovered judgment for damages suffered when he allegedly ran his motorcycle into an unlighted and unguarded excavation which defendant had made in a public street. Three points are urged for reversal, namely: that the evidence was insufficient as a matter of law to support the verdict; that plaintiff was guilty of contributory negligence; and, lastly, error in an instruction given to the jury.
