Appeal from a judgment of the superior court for Grant county, Steiner, J., entered January 2, 1913, upon findings in favor of the plaintiffs, in an action for equitable relief, tried to the court.

The plaintiffs brought this action to annul an executory contract and for the possession of lands described in the contract. The cause was tried to the court without a jury, and resulted in a judgment substantially as prayed for in the complaint. The defendant has appealed.
The facts are, in substance, as follows: On the 16th day of August, 1909, the respondents, J. D. Heard and wife, entered into a written contract with' one L. V; Wells.
