Kapsner, Justice.

[¶1] Industrial Contractors, Inc., appeals from a judgment affirming a decision by an independent administrative law judge determining Leonard Taylor’s employment with Industrial Contractors was not seasonal employment. Industrial Contractors *682argues the ALJ misapplied the law for determining seasonal employment. We conclude the ALJ misapplied the law and the ALJ’s decision is not supported by a preponderance of the evidence. We reverse and remand.
