HOLLAND, Justice:

This is an appeal by the State of Delaware from an order of the Superior Court. In that order, the Superior Court denied the State’s right to appeal from a mid-trial ruling in the Justice of the Peace Court, which dismissed various motor vehicle offenses and criminal charges that had been filed by the State against the appellee, Ra-cey Pusey (“Pusey”). The Superior Court concluded that a dismissal which followed the attachment of jeopardy was in actuality an acquittal.
