Declaration, special count on life policy and common counts; plea of general issue with notice of special matters relied on for defense: 1. January 15, 1873, the appellee insured the life of Howell G. Pulling in the sum of ten thousand dollars, payable to the appellant, his wife. Among the conditions of the policy was: “ Third.
