Plaintiff Peter Laniok commenced this action pursuant to 29 U.S.C. §§ 1001, 1132 of the Employee Retirement Income Security Act (“ERISA”), alleging that he had been unfairly denied pension benefits by his former employer, the Brainerd Manufacturing Company. In its answer, the defendant averred as its first affirmative defense that Laniok signed a waiver at the commencement of his employment foreclosing him from participating in the company pension plan.
