This matter is before the court on defendants’ motion for summary judgment pursuant to Fed.R.Civ.P. 56. Plaintiff filed this action under 42 U.S.C. § 1983, alleging that he was constructively discharged in violation of his procedural and substantive due process rights and in retaliation for exercising his First Amendment rights. The plaintiff also seeks recovery on pendent state law claims of invasion of privacy, defamation, and intentional infliction of emotional distress.
