WASSERSTROM, Chief Judge.

Defendant appeals from his conviction of passing a bad check with intent to defraud in violation of Section 570.120, RSMo 1978. The trial was to the court pursuant to defendant’s waiver of trial by jury.

The only evidence was that adduced by the prosecution. That evidence showed the following facts. Prior to April 1979, Mr. and Mrs. Paul Cridlebaugh bought a Brock-way truck from defendant without any untoward incident.
