The information charges that the defendants on the 30th day of January, 1928, with intent to defraud one Margaret J. Collins, unlawfully did make, draw, utter and deliver to her a check for $808, knowing at the time of such making that they were without sufficient funds to pay the check.

Margaret J. Collins, the complaining witness, was employed by the defendants as stenographer and secretary. She was first in the employ of the defendants from May 10, 1927, until February 11, 1928, and re-entered their employ on March 5, 1928, and remained until May 19, 1928.
