Defendant was found guilty of issuing a check in payment of a past-due debt, he knowing at the time that he did not have sufficient funds in or credit with the bank upon which the check was drawn for the payment of the check. His punishment was a fine of $200. The offense charged is a misdemeanor under Section 4305, Revised Statutes 1929 (4 Mo. Stat. Ann., p. 2998). Defendant by motions to quash the information and for a new trial and by other timely objections, put into the case the question whether Sections 4305 and 4306 are in violation of Section 16, Article II of our State Constitution…
