DAY, District Judge.
This is an application for a writ of habeas corpus by one John H. Lee who is serving a sentence in the Rhode Island State Prison pursuant to the judgment of the Superior Court of the State of Rhode Island following his convic tion by a jury on a charge of committing a criminal abortion.
