Defendant was charged with the traffic infraction of driving under the influence of intoxicants. ORS 487.540. This is an appeal by the state challenging the sanction imposed after an omnibus hearing for a violation of the discovery statutes. ORS 135.815.
The state assigns as error the following: (1) the trial court’s ruling excluding the testimony of an officer as a sanction for loss of that officer’s report relating to the initial stop of defendant, and (2) the court’s holding that the state’s evidence was insufficient to corroborate defendant’s statement that he was driving.
