Statement of the Case
Plaintiff and respondent, Lillian S. Strong (Strong), filed a complaint for declaratory relief against defendant and appellant, Donald R. Theis (Theis), trustee of the trust established under the will of Mildred Bethke, seeking a determination of the rights and duties of Strong and Theis under an agreement dated August 20, 1965, entered into between Strong and Mildred Bethke, also known as Mildred McDonald and Mildred Theis (decedent).
